JAIPUR: The Rajasthan high court on Tuesday directed the board of secondary education not to issue eligibility certificates to all those reserved category candidates appearing for Rajasthan Teachers Eligibility Test (RTET) who have been given additional relaxation by the state government besides the prescribed relaxation in minimum passing marks fixed by NCTE.

Justice M N Bhandari issued the order on a petition filed by D K Sharma and others. It was contended that the National Council for Teacher Education (NCTE) being the apex body has issued a notification on August 23, 2010 wherein the minimum pass marks fixed were 60% but later in July 2011 the said cutoff marks were reduced by granting relaxation of 5% marks to the reserve category candidates. It was also argued by the petitioners that the sate government, bypassing the legal position, granted relaxation from 10% to 20% to various classes of reserved candidates, which was previously stayed by the high court in 2011.

It was apprehended by the petitioners that again the board of secondary education will grant similar benefits this year as has been given in 2011. Taking a note of the contentions, the judge issued a show cause notice to principal secretary, panchayati raj, principal secretary, education and board of secondary education, Ajmer and directed that no candidate belonging to reserved category and securing less than 55% marks be given qualifying certificate in RTET examination, 2012.

A single bench of Justice Manish Bhandari passed the order on an application by one Deependra Kumar Sharma and others.

The petitioner said the NCTE issued a notification in which the minimum eligibility for teacher recruitment was kept at 60% and the candidate will have to pass RTET. 

On July 29, another notification was issued and a relaxation of 5% was awarded for reserved category. 

Meanwhile, state government gave a relaxation of 10% to ST, SC, OBS, SBCV and women, while women from reserved category, widows and divorcees were given a relaxation of 15% along with a 20% relaxation to differently abled.

Challenging its decision, the petitioner said the state government went against NCTE’s notification and gave over 5% relaxation to reserved category due to which if certificates are issued to those with less than 55% marks, the interests of the applicants will be affected.

The high court also ordered all zila parishads of state not to appoint those candidates of the 3rd category teachers who have passed RTET-2011 while doing BSTC first-year course. It ordered Secondary Education Board not to issue certificates of RTET to candidates without testing eligibility. 

Petitioner Naresh Nama said in third category teacher recruitment by Bara Zila Parishad, candidates who had passed RTET exam while in first year BSTC course, whereas those who are in the final year of BSTC course are eligible to appear for RTET.

सीकर.ग्रेड थर्ड शिक्षक भर्ती के सैकंड लेवल में कई अभ्यर्थियों ने नियुक्ति को लेकर सवाल खड़े कर दिए हैं। आरोप लगाए जा रहे हैं कि पंचायत समिति अलॉट करने में धांधली की गई है। कम मेरिट वाले अभ्यर्थियों को मनमाफिक पंचायत समिति दी गई तो ज्यादा मेरिट वालों को उनकी पंचायत समिति की बजाय दूर की पंचायत समिति अलॉट की गई है। सूत्रों के अनुसार, संस्कृत में फतेहपुर की एक महिला अभ्यर्थी को दांतारामगढ़ लगा दिया गया। 

जबकि उसका कहना है कि उसने फतेहपुर मांगा था। अभ्यर्थी का कहना है कि इसके नीचे की मेरिट वाले अभ्यर्थियों को फतेहपुर ही लगाया गया है। इसी तरह सामाजिक ज्ञान में शिवनगर के एक अभ्यर्थी ने धोद में नियुक्ति मांगा था। उसे लगाया गया है कि श्रीमाधोपुर पंचायत समिति में। विज्ञान विषय में झुंझुनूं की एक अभ्यर्थी को पिपराली लगाया गया है। इसी तरह एससी वर्ग में विज्ञान विषय में वरियता सूची में अव्वल महिला अभ्यर्थी का कहना है कि उसने पिपराली, लक्ष्मणगढ़, फतेहपुर व धोद मांगा था लेकिन उसे खंडेला लगा दिया गया।

निशक्तजन को भी नहीं लगाया

संस्कृत विषय में खातीपुरा के एक अभ्यर्थी का आरोप है कि विकलांग श्रेणी में पहली वरीयता पर वह आया था।इसमें एक ही पोस्ट थी।विज्ञापन में ही यही दर्शाया गया। मेरिट जारी करने के बाद उसे बुलाया भी गया मगर नियुक्ति नहीं दी। पूछने पर जिला परिषद ने तर्क दिया कि पहली पोस्ट नेत्रहीन के लिए थी।

क्या रही विषय वाइज ऊपर और निचले स्तर की मेरिट

सामाजिक ज्ञान : सामान्य वर्ग में पहली मेरिट150.63 और निचले स्तर की मेरिट 109.51 अंकों की रही। ओबीसी वर्ग में ऊपरी पायदान 132.38 तो निचली पायदान की मेरिट 123.86 अंकों की पहुंची। एससी वर्ग में पहली मेरिट 131.06 अंकों की रही। जबकि निचली मेरिट 106.5 अंकों की। इसी तरह एसटी वर्ग में ऊपरी मेरिट 131.47 अंकों की और निचली मेरिट 103.37 अंकों की रही।

अंग्रेजी : सामान्य वर्ग में टॉप मेरिट 177.74 अंकों तक पहुंच गई। जबकि निचली मेरिट 146.08 अंकों तक ही आ सकी। एससी वर्ग में पहली मेरिट 139.99 और निचली मेरिट 123.11 अंकों की रही। एसटी वर्ग में ऊपरी मेरिट 123.13 अंकों की और निचली मेरिट 95.54 अंकों पर पहुंची।

संस्कृत : सामान्य वर्ग में ऊपरी मेरिट175.35 अंकों का आंकड़े तक पहुंच गई। जबकि निचली मेरिट 166.44 रही। एससी वर्ग में पहली मेरिट 163.92 और निचली मेरिट 128.52 अंकों और एसटी वर्ग में ऊपरी मेरिट163.66 तथा निचली मेरिट 134.23 अंकों पर पहुंची।

उर्दू : ऊपरी मेरिट 131.58 अंकों और निचली मेरिट 126.22 अंकों की रही।

हिंदी : सामान्य वर्ग में पहले पायदान की मेरिट 186.07 अंकों की रही। जबकि निचली मेरिट 154.73 अंकों की। एससी वर्ग में पहली मेरिट150.73 अंकों की रही।निचली मेरिट 142.23 की। एसटी वर्ग में पहली मेरिट 141.31 तो निचली मेरिट 127.75 अंकों की रही।

कोटा.पंचायतीराज विभाग में अभी भर्ती हो रहे शिक्षकों को अब जिंदगीभर गांवों में ही सेवाएं देनी होंगी। वे चाहकर भी कभी शहर में स्थानांतरण नहीं करा सकेंगे। सरकारी आदेश भी इसमें असर नहीं डाल पाएंगे। पहले पांच साल तो वे एक स्थान से दूसरे स्थान पर स्थानांतरण भी नहीं करा सकेंगे। 
पंचायतीराज के तहत अभी लेवल एक व लेवल दो की शिक्षक भर्ती हो रही हैं। यह सभी शिक्षक पंचायतीराज के अधीन होने से इन सभी को ग्रामीण क्षेत्र में ही अपनी सेवाएं देनी होंगी। उन्हें शहर में स्थानांतरित नहीं किया जाएगा।
नहीं आ सकेंगे शहर में
जिला परिषद के सीईओ पीसी पवन के अनुसार पंचायतीराज विभाग के आदेश जारी हो चुके हैं। जिन शिक्षकों को नियुक्ति दी जा रही है, वे ग्रामीण क्षेत्र में ही रहेंगे। वे प्रयास करके भी शहर में नहीं आ सकेंगे। हालांकि, वे शहर के आसपास के गांव में अपना स्थानांतरण करा सकेंगे। उन्होंने कहा कि नियुक्ति के पांच साल तक तो उनका स्थानांतरण भी नहीं हो पाएगा। इसका नियमों में प्रावधान किया गया है। उन्होंने बताया कि स्थानांतरण के मामले में जीओ (सरकारी आदेश) भी मान्य नहीं होंगे।
मेडिकल व पुलिस का सत्यापन जरूरी 
जिन शिक्षकों को नियुक्तिपत्र जारी किया गया है, उन्हें अपनी ज्वॉइनिंग पर मेडिकल फिटनेस व पुलिस का चरित्र प्रमाणपत्र भी देना होगा। यह प्रमाणपत्र अभी नहीं मांगा गया था। इसके साथ ही उनका दो साल का प्रोबेशनरी पीरियड रहेगा। इस दौरान उन्हें वेतन भी 8950 रुपए प्रतिमाह फिक्स मिलेगा।
आदेश का विरोध किया जाएगा
'सरकार के इस प्रकार के आदेश गलत है। पहले तो पांच साल का ही नियम था, इसे यदि जिंदगी भर के लिए कर दिया गया है तो विरोध किया जाएगा। वैसे अभी इस नियम की जानकारी मुझे नहीं मिली है। इसकी जानकारी लेने के बाद विरोध किया जाएगा। सरकार कैसे किसी को जिंदगी भर ग्रामीण क्षेत्र में रख सकती है।'

Why high expectations are from Young Generation.
Many of youths in India are doing contractual job. And those who are permanent and in the age 50-60 are getting very high pay less work.

Why such expectations are not from senior teachers/ employees.
In India there is huge Unemployment, And where youths can impart efficiency as they are having extra knowledge of computers / electronic gadgets and in terms of health ( less leaves, less family problems etc. etc.) they are better than old age employees.

 I am not saying , we should snatch income from senior employees but I am saying a lot of injustice happens with young age employees like engaging in contractual jobs wit less pay etc.

Rajasthan Teacher Eligibility Test RTET 2012 roll number has been released. 

The roll no or admit card are available on the Board of Secondary Education Rajasthan (BSER), Ajmer website http://rtetbser.com.
The student want to find out their roll no/ admit card can get this by submitting their application/Challan Number on the BSER website.

The Rajasthan Teacher Eligibility Test RTET 2012 is scheduled to be held on 9th September 2012 and roll numbers(roll nos) are essential to sit in the exam.
As per NCTE guidelines, a candidate must clear the teacher eligibility test to bacome teacher in basic education (RTE) . 

The successful candidate will become eligible to apply for the post of teacher in schools. As per NCTE guideline candidates can reappear in TET/ CTET/RTET type examination to improve score.

According to the Statistics of School Education (2009-10), the total number of teachers in the country from pre-primary to senior secondary is 67.23 lakh. To meet the Pupil Teacher Ratio (PTR) norms specified under the Right of Children to Free and Compulsory Education (RTE) Act, 2009, the Government has sanctioned 8.17 lakh additional teachers posts between 2010 and 2012 under Sarva Shiksha Abhiyan (SSA) 

The Government has taken several steps for preparing and providing quality teachers. The Centrally Sponsored Scheme of Teacher Education for the XII Plan envisages establishment of District Institutes of Education and Training in all districts created upto March, 2011 and of Block Institutes of Teacher Education for expanding capacity of teacher preparation. The National Council for Teacher Education (NCTE) grants recognition to institutions for starting programmes of teacher education. Several State Governments have also taken steps to expand teacher preparation capacity. In pursuance of the RTE Act, the NCTE has laid down the minimum teacher qualifications, including the requirement of passing the Teacher Eligibility Test as an essential qualification for being eligible for appointment as a teacher. Under the Sarva Shisksha Abhiyan, financial assistance is provided to the State Governments to enable the teachers of class I-VIII not possessing the minimum qualifications to acquire the same by 2015, and for training of in-service teachers for improving quality. 

This information was given by Dr. D. Purandeswari, Minister of State for Human Resource Development in a written reply to a question in the Lok Sabha today.

जयपुर.विज्ञान विषय की द्वितीय श्रेणी शिक्षक भर्ती परीक्षा 2011 में अंग्रेजी माध्यम के परीक्षार्थी को हिन्दी माध्यम का प्रश्न पत्र देने पर हाईकोर्ट ने आरपीएससी से स्पष्टीकरण मांगा है। अदालत ने आरपीएससी से पूछा है कि जब भर्ती परीक्षा में परीक्षार्थियों को हिन्दी व अंग्रेजी माध्यम का विकल्प दिया था तो उन्होंने अंग्रेजी माध्यम के परीक्षार्थी को हिन्दी माध्यम का प्रश्न पत्र क्यों दिया। यदि एक माध्यम में ही प्रश्न पत्र देने का निर्णय लिया था तो इसकी सूचना परीक्षार्थियों को क्यों नहीं दी। मामले की आगामी सुनवाई 14 अगस्त तक एक पर खाली रखने का निर्देश दिया।

कोर्ट ने यह अंतरिम आदेश नरेश कुमार की याचिका पर दिया। इसमें कहा कि विज्ञान विषय की द्वितीय श्रेणी शिक्षक भर्ती परीक्षा 20 दिसंबर को हुई थी लेकिन इसमें परीक्षार्थी को अंग्रेजी माध्यम होने के बावजूद भी प्रश्न पत्र हिन्दी में दिया। माध्यम अलग होने के कारण परीक्षार्थी प्रश्न पत्र सही तरीके से हल नहीं कर सका और उसके अंक कम आए।

इसे हाईकोर्ट में चुनौती देने पर आरपीएससी ने जवाब में कहा कि फुल कमीशन ने तय किया था कि सभी विषयों के प्रश्न पत्र हिन्दी भाषा में ही दिए जाएं और केवल तकनीकी शब्दों को ही अंग्रेजी में लिखा जाए, इसलिए सभी विषय में हिन्दी माध्यम में प्रश्न पत्र दिए।

बीकानेर.राज्य में द्वितीय श्रेणी शिक्षक भर्ती में गणित और सामाजिक विज्ञान विषय के अभ्यर्थियों को नियुक्तियां देने पर फिलहाल रोक लगा दी गई है। अन्य तीन विषयों में नियुक्तियां देने की प्रक्रिया ने गति पकड़ ली है। 

द्वितीय श्रेणी शिक्षक भर्ती के लिए गणित और सामाजिक विज्ञान विषयों की परीक्षा में गलत प्रश्नों का मामला हाईकोर्ट में चले जाने के कारण राजस्थान लोक सेवा आयोग ने फिलहाल इन दोनों विषयों पर नियुक्तियां देने से मना कर दिया है। इससे दोनों विषयों के 6746 अभ्यर्थी प्रभावित होंगे। आयोग इस मसले को सुलझाने में लगा है। इस संबंध में आयोग ने माध्यमिक शिक्षा निदेशक को पत्र लिखकर स्थिति स्पष्ट की है तथा मसला सुलझने तक नियुक्तियां नहीं देने को कहा है। 

इसके अलावा माध्यमिक शिक्षा निदेशालय ने अन्य तीन विषय अंग्रेजी, विज्ञान और हिंदी में चयनित अभ्यर्थियों को नियुक्तियां देने की तैयारी शुरू कर दी है। शिक्षा मंत्री ने 31 अगस्त तक नियुक्तियां देने की बात कही है। उनकी घोषणा के मद्देनजर शुक्रवार को श्रीकृष्ण जन्माष्टमी के अवकाश के बावजूद माध्यमिक शिक्षा निदेशालय खुला रहा। अधिकारी इन तीनों विषय के अभ्यर्थियों को मंडल आबंटन की तैयारी में जुटे रहे। 

तीनों विषयों में प्रत्येक के 2373 अभ्यर्थियों को नियुक्तियां मिलेंगी। हालांकि इन विषयों के सभी फार्म निदेशालय नहीं पहुंचे हैं। प्रत्येक विषय के दो सौ से लेकर 400 फार्म आयोग में ही रुके हुए हैं। जितने फार्म निदेशालय को मिले हैं, उन्हीं अभ्यर्थियों को नियुक्तियां देने के आदेश मंडल उपनिदेशकों को दिए जाएंगे। उसके बाद आयोग जैसे-जैसे फार्म भेजेगा, नियुक्तियां होती रहेंगी

जयपुर। हाईकोर्ट ने तृतीय श्रेणी शिक्षक भर्ती के तहत नियुक्ति देने पर फिर रोक लगा दी है, इस बार कोर्ट ने सीनियर सेकेण्डरी में 45 प्रतिशत से कम अंक वालों को नियुक्ति नहीं देने के मामले को लेकर यह कार्यवाही की है।  न्यायाधीश मनीष भण्डारी ने रवि प्रकाश मीणा व अन्य की याचिकाओं पर यह अंतरिम आदेश देते हुए सुनवाई 13 अगस्त तक टाल दी।
प्रार्थीपक्ष के वकील डी.के. भारद्वाज ने कोर्ट को बताया कि प्रार्थी अनुसूचित जनजाति वर्ग से है और उसने 2004 में सीनियर सेकेण्डरी में 44 त्न अंक हासिल किए। 2010 में बीएसटीसी कर आरटेट उत्तीर्ण कर ली। तृतीय श्रेणी शिक्षक भर्ती के तहत सीकर जिले में एसटी के लिए कट ऑफ से अघिक अंक प्राप्त किए। फिर भी सीनियर सेकेण्डरी में 45त्न से कम अंक बताते हुए प्रार्थी को नियुक्ति नहीं दी। हाईकोर्ट ने सरकारी पक्ष के जवाब के लिए याचिका की कॉपी अतिरिक्त महाघिवक्ता एस.एन. कुमावत को देने का निर्देश दिया।
कोर्ट ने पिछले दिनों इस तरह के कई मामले सामने आने पर भर्ती प्रक्रिया बाद में विवाद में पड़ने की आशंका को देखते हुए नियुक्ति प्रक्रिया रोक दी। इससे पहले आरक्षित वर्ग के टेट में 60 प्रतिशत से कम अंक लाने वालों को सामान्य वर्ग में नियुक्ति देने पर रोक लगा दी थी, जो पिछले दिनों सरकारी पक्ष के जवाब के बाद हटा ली गई।

जयपुर। राजस्थान उच्च न्यायालय के न्यायाधीश एम एन भंडारी ने तृतीय श्रेणी अध्यापक भर्ती पर शुक्रवार को अंतरिम रोक लगा दी। यह भर्ती सभी मुख्यालयों के जिला परिषदों के माध्यम से की जा रही थी। न्यायाधीश भंडारी ने यह आदेश रवि प्रकाश मीणा, कृष्ण कुमार यादव एवं शोभा की अलग-अलग याचिकाओं की सुनवाई के बाद दी है। अदालत ने अतिरिक्त महाधिवक्ता एस एन कुमावत को 13 अगस्त 2012 तक जवाब देने के लिए कहा है। तब तक भर्ती पर अस्थाई रूप से रोक लगा दी है। 

याचिकाकर्ताओं के वकील देवेन्द्र भारद्वाज ने अदालत में याचिका दायर कर 12वीं कक्षा में 45 प्रतिशत से कम अंक वाले अभ्यर्थियों को भी भर्ती के योग्य मानने की मांग करते हुए कहा था कि तीनों अभ्यर्थियों ने 31.08.2009 से पहले प्रशिक्षण से पहले प्रवेश ले लिया था इसलिए उन्हें नियमानुसार 12वीं में 45 प्रतिशत न्यूनतम अंकों की अहर्ता से बाहर रखा जाना चाहिए। अदालत ने इस पर राज्य सरकार से जवाब मांगते हुए भर्ती पर अंतरिम रोक लगा दी है।

जयपुर। हाईकोर्ट ने शिक्षक पात्रता परीक्षा में 60 प्रतिशत से कम अंक वाले आरक्षित वर्ग के अभ्यर्थियों को तृतीय श्रेणी शिक्षक भर्ती में सामान्य वर्ग में नियुक्ति देने पर रोक हटा ली है। साथ ही, कहा कि नियुक्ति कोर्ट के आदेश से प्रभावित रहेगी, जिसका नियुक्ति पत्र में उल्लेख भी किया जाए।
न्यायाधीश मनीष भण्डारी ने पे्ररणा जोशी की याचिका पर सोमवार को यह अंतरिम आदेश दिया। प्रार्थीपक्ष ने कहा कि आरक्षित वर्ग वालों को शिक्षक पात्रता परीक्षा में 60 प्रतिशत से कम अंक पर उत्तीर्ण मान लिया है, इनमें से कुछ शिक्षक भर्ती में सामान्य वर्ग की मेरिट में आ रहे हैं। शिक्षक पात्रता परीक्षा में कम अंक पर उत्तीर्ण होने वाले आरक्षित वर्ग के अभ्यर्थियों को तृतीय श्रेणी शिक्षक भर्ती में उन्हीं की श्रेणी में नियुक्ति दी जाए।
राज्य सरकार के अतिरिक्त महाघिवक्ता एसएन कुमावत ने कहा कि इस याचिका के आधार पर पिछले दिनों कोर्ट द्वारा नियुक्ति पर लगाई रोक को हटाया जाए, शिक्षक पात्रता परीक्षा स्वतंत्र परीक्षा है। उसमें प्रमाण पत्र के लिए आरक्षित वर्ग को छूट दी है, जो हाईकोर्ट की खण्डपीठ ने भी जायज मानी है।
इधर, तृतीय श्रेणी शिक्षक सीधी भर्ती परीक्षा है, इस परीक्षा में शिक्षक पात्रता परीक्षा के 20 प्रतिशत अंक जोडे जाएंगे। ऎसे में शिक्षक भर्ती परीक्षा में ज्यादा अंक के कारण वह सामान्य वर्ग में नियुक्ति का पात्र होता है, उसे अनदेखा नहीं किया जा सकता। ऎसे अभ्यर्थियों की संख्या भी ज्यादा नहीं होगी,  ऎसे में नियुक्ति प्रक्रिया को नहीं रोका जाए। कोर्ट ने नियुक्ति की छूट देते हुए कहा कि राज्य सरकार नियुक्ति तो दे सकती है, लेकिन नियुक्ति पत्र में अंतिम निर्णय कोर्ट के फैसले के तहत होने का उल्लेख किया जाए।

Low marks in CTET/TET Qualifide candidate of reserved category can obtain General category candidates seat.

Jaipur: Giving relief to general candidates who appeared in the Rajasthan Teachers’ Eligibility Test (RTET) in 2011, Rajasthan high court has ordered not to include the reserved category candidates in the general category in 3rd grade teacher’s recruitment process.

The court has ordered that the candidates who got less than 60% in RTET should not be included in the recruitment in the general candidates’ list.


The court has also issued show cause notices to state’s principal secretary of panchayati raj department and principal secretary education and others in this matter.

The order was passed by the single bench of justice Manish Bhandari during the preliminary hearing on a petition filed by one Prerna Joshi.

RTET was conducted on June 2, 2011 and the candidates of reserved category who had got less than 60% in the test were included in the list meant for general candidates.

Petitioners informed the court that the candidates of reserved category had already been benefitted in the eligibility norms for appearing in RTET.

It was argued that if they would not have been given relaxation in the eligibility norms the reserved category candidates would not have been included in the test.

The petitioner thus demanded that since they have taken benefit under reserved category they should now not be included in the general category. RTET which was held for the first time in the state has been marred by several issues.

Initially it was slated to be held in May 2011 but it was later organised in June.

Earlier also in September 2011 , the high court had ordered the state government not to issue pass certificate to the candidates belonging to OBC category securing less than 60 per cent marks in the test.

Petitioner had that time informed the court that as per the right to education law, no relaxation can be given to reserved category candidates in pass marks as this amounted to non-compliance of section 335 of the Indian Constitution.

What was the decision of Rajasthan High Court Single Bench about Reservation Policy :

In view of the discussion made above, all these writ petitions are partly allowed  with the following directions -

1.    The circular dated 11.5.2011 would not be applicable to the present selection in view of the judgment in the case of K.Manjusree (supra), wherein, it was held that rules of game cannot be changed in the midst of selection  thus respondents are directed to make appointment without applying  circular dated 11.5.2011 in the present matter as initiation of recruitment is prior to the circular dated 11.5.2011 so as the advertisement. The migration of reserve category candidates to open/ general category  can be permitted as per earlier circular dated 24.6.2008 and Standing Order applicable to present selection and not as per circular issued on 11.5.2011 as it is much subsequent to the advertisement and not given retrospective effect.

2.    The circular dated 11.5.2011 provides for migration of reserve category candidates to open/ general category  in the case where the candidates have taken special concession. The aforesaid circular needs to be given proper interpretation. It would be applicable in the case where reserve category candidates have taken benefit of concession of fee and relaxation in age. In those cases, one would be allowed to migrate to open/general category if obtained equal or more marks to the last candidate in open/general category. In case of any other concession or relaxation during the process of selection by reserve category candidate, he would not be allowed to migrate to open/general category as the 'level playing field' during the course of selection does not remain the same. Thus, respondents are directed to implement  circular dated 11.5.2011 in the light of the directions given above but it would not be applicable to this selection as indicated in the first para of directions.

जयपुर.थर्डग्रेड टीचर भर्ती (लेवल वन) में हाईकोर्ट ने सामान्य वर्ग के पदों पर आरक्षित वर्ग के उन अभ्यर्थियों के चयन व नियुक्ति पर रोक लगा दी है, जिनके आरटेट परीक्षा में साठ प्रतिशत से कम अंक थे। अदालत ने प्रमुख शिक्षा सचिव व प्रमुख पंचायत सचिव को नोटिस जारी कर जवाब मांगा है।

न्यायाधीश एम.एन.भंडारी ने यह अंतरिम आदेश प्रेरणा जोशी की याचिका पर दिया। इसमें कहा गया है कि थर्ड ग्रेड टीचर भर्ती परीक्षा के लेवल वन में ऐसे अभ्यर्थियों का चयन सामान्य वर्ग में किया गया जिनके आरटेट में साठ प्रतिशत से कम अंक हैं, जबकि आरक्षित वर्ग के अभ्यर्थियों को सामान्य वर्ग में आरक्षण का लाभ नहीं दिया जा सकता।

हाई कोर्ट ने तृतीय श्रेणी पीटीआई (शारीरिक शिक्षक) के लिए सीपीएड धारक अभ्यर्थियों को ही योग्य माना है। यह आदेश पीटीआई भर्ती 2008 को लेकर दिया गया है।

अदालत ने परिणाम भी नए सिरे से जारी करने के निर्देश दिए हैं। कोर्ट ने सेवा नियमों में संशोधन की 9 दिसंबर, 2011 को जारी अधिसूचना को भी इस भर्ती में मानने से इनकार कर दिया। इस अधिसूचना में सरकार ने बीपीएड व डीपीएड धारकों को भी तृतीय श्रेणी पीटीआई के लिए योग्य माना था।

जयपुर। आरटेट परीक्षा में महिलाओं, विधवा सहित आरक्षित जातियों के विद्यार्थियों को पात्रता में छूट दिए जाने पर सुप्रीम कोर्ट में दायर एसएलपी वापस लिए जाने का निर्णय किया है।

इस स्थिति में 60 फीसदी अंक प्राप्त करने वाले विद्यार्थी ही पास माने जाएंगे। अब 2012 में तृतीय श्रेणी शिक्षकों पर संकट खड़ा हो जाएगा। राजस्थान बीएसटीसी शिक्षक संघ ने मुख्यमंत्री से एसएलपी वापस लेने के निर्णय पर पुनर्विचार करने की गुहार की है।
आरटेट परीक्षा की पात्रता में तत्कालीन सरकार ने 10-15 फीसदी तक की छूट दी थी। जिसमें महिला और एससी एसटी के लिए 15 फीसदी और ओबीसी को 10 फीसदी की छूट मिली, जबकि नियमानुसार केवल 60 फीसदी अंक हासिल करने वाले छात्रों को ही परीक्षा में उत्तीर्ण किया जा सकता था। ऎसे में मामले पर राजस्थान हाईकोर्ट में कई याचिकाएं दायर हुई थीं।
जिन पर हाईकोर्ट ने प्रक्रिया पूरी किए बिना छूट देने के निर्णय को 2 जुलाई, 2012 को गलत ठहराया था। तत्कालीन राज्य सरकार ने सुप्रीम कोर्ट में एसएलपी दायर करते हुए छूट दिए जाने की गुहार की थी।
अब सरकार ने तृतीय श्रेणी भर्ती परीक्षा को अलग से कराए जाने की जगह आरटेट, बीएड और अन्य योग्यता परीक्षा अंकों के आधार पर मैरिट लिस्ट तैयार कर शिक्षक भर्ती करने पर चर्चा कर रही है।
इसी के साथ सरकार ने एसएलपी को वापस लेने का निर्णय किया है। ऎसे में आरटेट पात्रता में दी गई छूट समाप्त हो जाएगी। छूट के आधार पर आरटेट परीक्षा उत्तीर्ण कर तृतीय श्रेणी शिक्षक पद पर चयनित अध्यापकों की नौकरी पर भी सवाल उठ जाएगा।
उठे विरोध के स्वर
राजस्थान बीएसटीसी शिक्षक संघ ने एसएलपी लिए जाने का विरोध करते हुए कहा, सरकार को एसएलपी के फैसले का इंतजार करना चाहिए, केवल प्रक्रिया की वजह से छात्रों के चयन पर सवाल उठाया जाना गलत है। संघ के अध्यक्ष उपेन यादव के मुताबिक, इस विष्ाय पर मुख्यमंत्री को ज्ञापन देकर छात्रों के हित में फैसला लेने की गुहार करेगें।

जोधपुर। राजस्थान हाईकोर्ट ने राजस्थान अध्यापक पात्रता परीक्षा (आर-टैट) 2011 में द्वितीय स्तर के पेपर में एक केंडिडेट द्वारा 150 प्रश्नों में से 60 प्रश्न सही किए जाने के बावजूद मात्र 47 नंबर दिए जाने को चुनौती देने वाली याचिका की सुनवाई में सचिव माध्यमिक शिक्षा बोर्ड राजस्थान, समन्वयक राजस्थान अध्यापक पात्रता परीक्षा 2011 को नोटिस जारी कर तीन सप्ताह में जवाब तलब किया है।
याचिकाकर्ता पाली जिले के धुंधला निवासी प्रकाश चौधरी की ओर से अधिवक्ता इन्द्रराज चौधरी ने अदालत में कहा कि प्रार्थी ने आर टैट 2011 में द्वितीय स्तर का पेपर बहुत अच्छा किया था। उसने 150 में से 80 प्रश्न सही किए, लेकिन उसे सिर्फ 47 अंक दिए गए। उन्होंने कहा कि प्रार्थी ने सूचना के अधिकार के तहत ओएमआर की नकल मांगी तो उसे दे दी गई लेकिन उत्तर तालिका की नकल नहीं दी गई।बाद में वेब साइट से डाउनलोड करने पर उत्तर तालिका भी प्राप्त हो गई जिसे देख कर प्रार्थी के दावे की पुष्टि होती है
